 A wetland is an area that is covered by shallow water or has waterlogged soils for long periods during the growing season in most years.

 Wetlands are of such great importance to the general public because of their impact on water quality that in 1986, the U.S. Government adopted a "no net loss" policy towards wetlands. This body of law, contained in the Clean Water Act, particularly sections 404 and 401, severely limits property owners rights to use or modify any property that is classified as regulatory wetlands.  Wetlands are closely monitored and regulated by law enforcement agencies at the state and federal level. The limitations imposed upon landowners of wetlands have a tremendous affect on land value and land use. 

 When we evaluate land for a buyer or seller, we use soil surveys, National Wetlands Inventory maps, and on-site soil sampling to identify the extent of regulatory wetlands. We discuss with our client how the presence of regulatory wetlands affects the land value and potential land use.
